911 Disclaimer
ADVISORY REGARDING americanVRS NUMBER AND 911 CALLS In obtaining your ten-digit geographic number from americanVRS, a service of American Network, Inc., you are selecting American Network as your default provider of Telecommunication Relay Services. This means that all calls to and from your americanVRS Number will be routed through American Network. . As your FCC certified TRS provider, americanVRS is required to comply with the Federal Communications Commission (FCC) mandate put into effect December 31, 2008 allowing persons with hearing and speech disabilities using Video Relay Service (VRS) to obtain ten-digit telephone numbers. This ten-digit number requirement was adopted by the FCC in conjunction with 911 call handling requirements for VRS and IP-Relay providers. Users of VRS and/or IP Relay are reminded, if they have not done so already, to register with the VRS or IP Relay provider of their choice as soon as possible, and no later than November 12, 2009. After November 12, 2009, all VRS and IP Relay users must be registered with a default provider in order to place a non-emergency call through any VRS or IP Relay provider. In addition, after that date, VRS and IP Relay providers will no longer complete calls to a “proxy” or “alias” number that may have been previously obtained from a provider. In compliance with this FCC mandate, americanVRS will (i) obtain the physical location from which you will access americanVRS (also known as your "Registered Location"); (ii) give you a method of updating your Registered Location information; and (iii) route all emergency 911 calls placed by you via americanVRS to the appropriate emergency personnel. In a 911 situation, americanVRS will transmit the callback number and your Registered Location, americanVRS's name as your service provider, and the identification number of the americanVRS video interpreter handling your 911 call. After registering with americanVRS as your default provider, you can place a 911 emergency call through americanVRS via your computer or videophone. To ensure that your 911 call is routed to the right emergency response center, and that the emergency response center knows where to send assistance, your default provider needs to know the physical address (i.e., the Registered Location) from which you are placing the emergency call. It is critical that you inform americanVRS of your Registered Location and give americanVRS advance notice of any subsequent changes to this location. If you are planning to move to a new address where you will use your computer or videophone to place VRS calls, you must register that new location with americanVRS. Please note that it can take several hours or, in some cases (e.g., if there is an error in your Registered Location) longer, to activate 911 service at an initial or new Registered Location of your computer or videophone. americanVRS will confirm receipt of your Registered Location or any updates that you submit. If you move to a new address without having given americanVRS sufficient advance notice, any 911 call you make from your videophone or computer may be directed to the wrong emergency authority or may transmit the wrong address. For more information about ten-digit telephone number(s) for TRS, see the FCC's Consumer Advisory on New Ten-Digit Numbering and Emergency Call Handling Procedures for Internet-Based Telecommunications Relay Services, located at the FCC website. Unless otherwise noted, this Agreement assumes that you have chosen americanVRS as your default VRS provider for the americanVRS Number assigned to you. CALLS TO EMERGENCY SERVICE PROVIDERS (911/E911) WAIVER OF LIABILITY FOR 911 CALLS. Any emergency calls to 911 ("911 Call"), should be made through a traditional text telephone ("TTY") whenever possible or, if a TTY is not available, a standard telephone. Dialing 911 from a TTY or standard phone remains the most reliable and fastest method of reaching emergency personnel. In the event that you use americanVRS to make a 911 Call, americanVRS is not liable for any claim, damage or loss arising from your use of its services to facilitate that call. Specifically, americanVRS is not liable in tort, contract, or otherwise for any personal injury, property damage, or death arising out of or related to use of its services to make a 911 Call, or the provision of any IP-based, video remote, or in-person interpreting services incidental to or in conjunction with such a call, including but not limited to an act or omission involving (1) the development, design, installation, operation, maintenance, performance, or provision of any equipment or facility that permits you to use americanVRS's services, or any IP-based, video remote, or in-person interpreting services provided in connection with a 911 Call or the provision of emergency services; (2) misinterpretation, mistakes, interruptions, delays, transmission errors, network outages, failures, defects, technical difficulties, acts of God, or other occurrences, regardless of the source of the occurrence, that may arise in the course of transmitting or handling 911 Calls or providing emergency services; and (3) release to a public safety answering point, designated statewide default answering point, appropriate local emergency authority, emergency medical service provider or emergency dispatch provider, public safety, fire service or law enforcement official, or hospital emergency or trauma care facility of user information related to 911 Calls or the provision of emergency services. In addition, americanVRS is not liable for any damages arising from your failure to provide americanVRS an accurate, up-to-date Registered Location. For information about how to update your Registered Location, please refer to the 911 Update above. Furthermore, consistent with Federal law, americanVRS in its role as an emergency communications service provider, shall have immunity or other protection from liability in a State of a scope and extent that is not less than the scope and extent of immunity or other protection from liability accorded any local exchange company under Federal and applicable State law (whether through statute, judicial decision, tariffs filed by such local exchange company, or otherwise). NOTICE OF LIMITATIONS FOR 911 CALLS. If you use americanVRS's services to place a 911 Call, you should be aware that any such use is subject to significant limitations and risks. First, your location and any telephone number associated with your videophone or computer may not be automatically passed to emergency service personnel when you use americanVRS's services to place a 911 Call. Second, if you use americanVRS's services to place a 911 Call, and you are incapacitated or otherwise unable or unwilling to give the americanVRS interpreter your address, americanVRS may not be able to obtain your location information and give it to appropriate emergency personnel, although americanVRS will use its best efforts to do so. Third, if you use americanVRS's services to place a 911 Call, and you have not provided americanVRS an up-to-date Registered Location, americanVRS may not automatically be able to obtain your location information or route your call to the appropriate emergency personnel. Fourth, even if you have provided americanVRS an up-to-date Registered Location, it can take several hours or, in some cases (e.g., if there is an error in your Registered Location), longer to activate 911 service at this address. If you place a 911 Call from an address before activation of 911 services for that address, americanVRS may not automatically be able to obtain your location information and/or route your call to the appropriate emergency personnel. Fifth, you may not be able to place a 911 Call if equipment provided to or used by you fails to function. Sixth, you may not be able to use americanVRS's services to place a 911 Call if an act beyond our control (including an act of God) has occurred, including one or more of the following: a broadband network outage or power outage has occurred, or Internet service has been degraded for another reason, including congestion, interruptions, or technical problems that may affect your ability to access the Internet; your broadband or ISP service has been cancelled, suspended or terminated for any reason (including for failure to pay or other reasons) or your use of relay service equipment has been terminated, suspended, restricted, or cancelled, or such equipment has been disabled. Finally, 911/E911 is only available for a call placed from a location within the United States. americanVRS will not be liable for any cost or damage arising either directly or indirectly from your failure to observe the limitations expressed in this Disclaimer, including your use or misuse of americanVRS's services, or (ii) americanVRS's termination, suspension, restriction, or cancellation of your use of its services, and/or americanVRS retrieval or disabling of its videophone. In no event shall americanVRS, or its shareholders, officers, or directors, be liable for punitive, reliance, or special damages, or for indirect or consequential damages, including but not limited to lost profits or revenue or increased costs of operation. These limitations apply even if the damages are foreseeable or we are told they are possible, and they apply to any negligence claim that does not involve willful misconduct or intentional misconduct no matter how that claim is styled or on what legal grounds (such as contract, tort, statute, misrepresentation) it is based. americanVRS will be liable for no more than the amount of direct damages to the person or property. Except as expressly provided in this Disclaimer, and then only to the extent provided, americanVRS makes no warranties or representations of any kind regarding its services. PERMISSIVE DIALING PERIOD. Between December 31, 2008, and November 12, 2009, VRS or IP Relay users who have received ten-digit geographic numbers may still receive calls to their former “proxy” or “alias” numbers. Default providers will provide messages notifying callers of their users’ new ten-digit geographic numbers and advising callers that, after November 12, 2009, users may only be reached by dialing the new number. (Please note that, after November 12, 2009, any toll-free number used to route VRS or IP Relay calls must be directed to the appropriate ten-digit geographic number) americanVRS DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR PARTICULAR PURPOSE. americanVRS makes no warranty that its services will be uninterrupted or error free. americanVRS shall not be liable for any consequential or incidental damages. americanVRS does not authorize anyone, including, but not limited to, americanVRS's employees, independent contractors, agents or representatives, to make a warranty of any kind on americanVRS's behalf and you should not rely on any such statement.
User Agreement
When possible, I will dial 911 through a TTY or a standard telephone and I understand that it remains the safest and most reliable method of reaching emergency responders.
I understand the process for obtaining a 10 digit number from americanVRS and the terms and conditions pertinent to this number.
I understand the portability of the 10 digit number that has been assigned to me. I possess the right to port my 10 digit number to any other VRS provider and any other VRS provider must be able to port the10 digit number that is registered with them to americanVRS.
I understand that I need to submit, update, and confirm my registered physical location information to americanVRS. In the instance that I move, I will send americanVRS my updated address information.
I understand the importance of providing and maintaining accurate up- to- date registered information to americanVRS in the event that they need to contact emergency 911 personnel.
I understand I am responsible for providing accurate and truthful location information to americanVRS and for updating my location information when I relocate or travel. I acknowledge that updating my location information takes time and americanVRS is not responsible for any claims or damages that may arise in the interim.
I understand americanVRS is not liable for any claims or damages arising from use or abuse of its 911 services and I agree to indemnify americanVRS from any claims or causes arising from my use or abuse of its 911 services.
